What would happen if you were caught with pot in Mexico?

Marijuana is not legal in Mexico, but if a Mexican national possesses small quantities of any kind of drug, for his/her own use – they will not be prosecuted for possession. Smuggling, transporting, selling it or giving it away are all different crimes and are prosecuted. If you are a foreigner in Mexico, you may not be prosecuted for possession, but if you admit you brought it into the country, you will be arrested for drug smuggling. If you say that it is for your own use and you obtained it/found it, you won’t be prosecuted but you may be deported. Most foreigners that get into trouble in Mexico are usually involved with drugs, alcohol or guns. On January 1, 2018, medicinal marijuana was legalized but until the Secretary of Health creates the regulations for its prescription, you cannot obtain a prescription. If you are a visitor to Mexico, be careful about your involvement with pot or any other drug.
