Cannabis in NYC: What Is Legal?
Cannabis (marijuana) is legal for adult use in New York State (NYS).
Adults age 21 and older
may have and share
(but not sell) up to 3
ounces of cannabis
flower or bud, and
up to 24 grams of
concentrated cannabis
such as oils or vapes.

smoke or vape
cannabis in
most places
where tobacco
smoking is
permitted.

Under federal law, it is still not legal to possess
or use cannabis in any form on federal property.
The NYS law outlined in this fact sheet does
not apply on any federal property.
Some private buildings prohibit smoking and
vaping inside units. While property owners
can prohibit cannabis smoking
and vaping in their building, they
cannot ban the use of edibles or
the possession of legal amounts
of cannabis inside your home.
NYCHA housing developments have smokefree policies that ban smoking and vaping
tobacco and cannabis on the property. Public
housing that is part of a federal program falls
under federal law prohibiting the possession
and use of cannabis and cannabis products.

How do I know if a cannabis product or
a location selling them is legal?
Licensed locations and products will be
marked with a verification logo. Licensed
products get tested and follow safety
standards set by the NYS Office of Cannabis
Management (OCM). If you have questions
or concerns about product safety, labeling,
health effects from a product, unlicensed
